Preparation of Reports and Expert Opinions in Compliance with the Efficiency-in-Justice Framework under Ley Orgánica 1/2025
In many disputes, traditional court-appointed expert evidence is requested once litigation is already underway, when the parties need a technical report to support their claims before a judge. However, an Independent Expert—mandated and encouraged under the procedural efficiency reforms of the Ley Orgánica 1/2025—adds significant value by intervening before or alongside the conflict. By offering neutral expert opinions, third-party valuations, independent forensic reports, and alternative dispute resolution services (MASC/ADR) in line with the statutory reform, the Independent Expert may prevent escalation or help reach faster and more robust agreements. Unlike an expert engaged by one party (perito ad litem), the Independent Expert maintains total impartiality, which strengthens confidence in the reliability of their conclusions and aligns with the obligation, set out in Ley Orgánica 1/2025, to explore pre-litigation dispute resolution, mediation, and neutral expert assessment.
